First case in state under new law is a theft at Damchara and second case at Kailashahar PS on Motor accident

The first case in the state registered under the new Bharatiya Nyaya Sanhita (BNS) law is a theft case,registered yesterday 12.30 pm, case No 15/2024, US 305 of BNS at Damchara police station in North Tripura district.This case marked the beginning of legal proceedings under the newly introduced Bharatiya Nyaya Sanhita (BNS) criminal code.

According to information received from the Tripura Police Headquarters, Tripura's second case under the BNS was filed at Kailashahar police station at 2:40 pm yesterday on charges of rough motor vehicle driving, Kailashahar PS- Case No 83/24 U/S 281/106(1) of BNS & 184/187 M.V. Act, the case number 83/224 registered at Kailasahar Police Station.

According to the complaint, a 65-year-old man died after being hit by a magic car on Monday afternoon. After this incident in Ichabpur village of Kailashahar, the police quickly registered the case. The case was taken up under Sections 281 and 106 of BNS.

In the new law, section 281 and section 161 (1) of the BNS Act will increase the term of punishment in case of death due to vehicle accident. However, if the accused driver escapes without informing the police or the magistrate after the accident, the punishment will be longer. That is, if the driver informs the police on his own after the vehicle accident, the jail time will be less. If you run away without telling anyone, the jail term will increase. In the new law, it is summarized as hit and run. But the clause of hit and run will not be effective from July 1.

Under the old law, the driver could have been jailed for two years and fined if he died in a car accident. Currently, under Section 281 of the BNS, the punishment can be up to ten years in jail.
