Tripura High Court Restrains Salary Payment to TTAADC Top Officials Over Non-Payment of Retiral Dues

The Tripura High Court has imposed an interim restriction on the payment of salaries to senior officials of the Tripura Tribal Areas Autonomous District Council (TTAADC) over alleged failure to clear the outstanding retiral benefits of several retired employees.
The order was passed in connection with three separate writ petitions filed by 100 retired TTAADC employees who claimed that their legitimate dues, including gratuity, leave encashment benefits and commutation of pension, had not been paid despite their retirement.
According to the news report, the High Court has directed that the Chief Executive Officer (CEO) of the concerned District Council and other senior officials should not receive their salaries, while the issue of payment of dues to the retired employees is being considered by the court. The restriction is intended to put pressure on the authorities to address the outstanding payments.
The petitions reportedly concern employees who retired around a year ago but were still waiting for their admissible retiral benefits. The petitioners argued that despite repeated requests, the District Council had failed to release the amounts due to them.
During the proceedings, the High Court also sought clarification regarding the financial position of the District Council and the role, if any, of the State Government in arranging funds for payment of the retired employees' dues. The report states that the court was informed that the District Council has its own funds and that questions had arisen regarding the role of the State Finance Department.
The matter was reportedly heard on September 9, when counsel appearing for the District Council submitted arguments before the court. The court also sought the views of the Advocate General on the issue. According to the report, the State Government's counsel indicated that the government itself did not have a direct role in the District Council's financial affairs.
The High Court subsequently directed that a copy of the order relating to the salary restriction be forwarded to the Chief Secretary, Finance Secretary, Treasury Officer and the Chief Executive Officer of the TTAADC, among other concerned authorities, for necessary action.
The report further states that a significant number of retired TTAADC employees have allegedly remained without their retiral benefits for an extended period. It mentions that around 100 retired employees have approached the High Court in connection with their outstanding dues, while in some cases the court has already directed payment of the admissible amount along with 9 per cent interest.
The development has therefore raised broader questions about the financial management of the Autonomous District Council and the timely settlement of retirement benefits of its employees. The court's intervention also puts the functioning of the Council's financial and administrative machinery under increased judicial scrutiny.
The three writ petitions are expected to come up for further hearing, with the petitioners seeking enforcement of their entitlement to retirement benefits. The report names senior advocates Purushottam Roy Barman and Samarjit Bhattacharjee, along with advocate Kaushik Nath, among those appearing for the petitioners.
The High Court's interim order does not constitute a final adjudication of the underlying dispute; the parties will have an opportunity to place their respective positions before the court in the subsequent proceedings.
