Tripura HC directs release of family pension, compassionate appointment

The Tripura High Court has directed the state government to release family pension to the widow of a deceased fire services employee and provide compassionate appointment to his daughter within four months.

A single bench of Justice Biswajit Palit passed the order on a petition filed by Moushumi Das and her daughter Eshika Das. Moushumi’s husband, Prasenjit Das, a Leading Fireman, died in harness on December 20, 2024.

The petitioners had sought family pension and other benefits, besides compassionate appointment for Eshika under the Die-in-Harness Scheme.

The court noted that Eshika was eligible and that the Director of Fire and Emergency Services had forwarded her appointment proposal in July 2025. However, the Finance Department said there was no vacancy and advised consideration when one arose.

The court observed that the scheme contemplated appointment within one year of the employee’s death and the authorities had failed to do so.

On family pension, the court held that “for outstanding liability of the deceased there is no scope as per law to withhold the family pension”.

The court directed release of the family pension according to eligibility and appointment of Eshika, including in another suitable department if necessary.
