FIR Against Former Chief Minister Manik Sarkar Over Political Remarks Sparks Legal and Political Debate

A fresh political and legal controversy has erupted in Tripura following a complaint seeking registration of an FIR against former Chief Minister and CPI(M) leader Manik Sarkar over remarks allegedly made in connection with a recent political programme and the ongoing agitation in the state.

According to the complaint submitted before the Officer-in-Charge of Sidhai Police Station, the complainant has alleged that Sarkar’s recent political statements could further intensify the ongoing agitation and create tension in the state. The complaint reportedly refers to his remarks concerning the Manik Sarkar-led government’s handling of the movement and alleges that the statements could have the potential to provoke political unrest and disturb public peace.

The complaint was reportedly submitted in connection with a political programme held in Agartala on August 10, 2026. The complainant has argued that the former Chief Minister, being an influential political personality, could have a greater impact on supporters and activists through such statements. It has therefore urged the police to examine the remarks carefully and take appropriate action in the interest of public order and security.

The complaint has invoked several provisions of the Bharatiya Nyaya Sanhita, 2023, including Sections 147, 148, 152 and 353(1), along with other applicable provisions, and has requested registration of a criminal case after examining the contents and context of the alleged statements. Section 147 concerns waging or attempting to wage war, or abetting the waging of war, against the Government of India, while Section 148 deals with conspiracy relating to offences under Section 147. Section 152 deals with acts endangering the sovereignty, unity and integrity of India.

However, a crucial issue has emerged in the matter is that the complaint, as described, does not appear to be accompanied by concrete evidence establishing that the former Chief Minister actually incited violence, armed rebellion, militancy or any activity endangering the sovereignty or integrity of India. The allegations in the complaint and the legal sections cited therein are not, by themselves, proof that the alleged offences were committed.

This distinction could become particularly important for the police while deciding the next course of action. Section 152 of the BNS specifically requires an examination of whether a person purposely or knowingly, through words, writings, electronic communication or other means, actually excites or attempts to excite secession, armed rebellion or subversive or separatist activities, or otherwise endangers the sovereignty, unity and integrity of India. At the same time, the provision itself contains an explanation protecting criticism of government measures when such criticism seeks change through lawful means without inciting the prohibited activities.

Therefore, merely making a strong political criticism of the government or criticising its handling of an agitation would not automatically establish an offence under Section 152. The exact words used, the context in which they were delivered, the intention behind the remarks and their actual or likely impact would all be relevant to any criminal investigation.

This appears to have placed the police in a delicate position. On one hand, the complaint has specifically demanded criminal action and has cited serious provisions of the BNS. On the other hand, there is reportedly no concrete material accompanying the complaint that conclusively establishes that Sarkar propagated violence or renewed militancy in Tripura.

Police sources are understood to be examining the complaint and the statements attributed to the former Chief Minister before deciding whether a formal FIR should be registered or whether further preliminary verification is required. It is also being reported that police may issue a notice to Sarkar, in accordance with law, seeking clarification or recording his version regarding the statements attributed to him.
