Allegations Surface Against Tripura Food Department for Defying High Court Verdict in Favour of Former District Consumer Commission President

The Food, Civil Supplies & Consumer Affairs Department of the Tripura Government has come under serious allegations of failing to implement a judgment of the Hon'ble High Court of Tripura in favour of Gautam Sarkar, former President of the District Consumer Disputes Redressal Commission (District Consumer Court), despite the Court having set aside his removal from service.
In a fresh representation dated July 7, 2026, addressed to the Director of the department, Sarkar referred to the High Court judgment dated May 26, 2026, passed in WP(C) No. 354 of 2026, stating that a copy of the judgment had already been forwarded to the department for necessary action.
According to the representation, the High Court's judgment continues to remain operative, binding and enforceable, and to the best of his knowledge, no superior court has passed any order staying or suspending its operation. Despite the lapse of considerable time, Sarkar alleged that the department has not taken any steps to comply with the directions contained in the judgment.
"I, therefore, request your good office to kindly take necessary steps for due compliance with the judgment and order of the Hon'ble High Court in its true letter and spirit, expeditiously and strictly in accordance with law," Sarkar stated in his representation.
Sarkar further submitted that while his salary has been released only up to February 12, 2026, the removal order having been set aside by the Hon'ble High Court, the basis for withholding his salary and other consequential service benefits no longer exists.
"I, therefore, call upon the Department to release the outstanding salary and all admissible consequential service benefits for the period commencing from 13.02.2026 onwards, in accordance with law," the representation states.
He has also urged the department to act without any further delay, warning that continued inaction would compel him to seek legal recourse.
"It is expected that appropriate action shall be taken without any further delay. In the event of continued non-compliance with the judgment and order of the Hon'ble High Court, the undersigned shall be constrained to seek such remedies as are available in law, including appropriate proceedings before the Hon'ble High Court," Sarkar stated in the letter.
The latest representation follows his earlier communication forwarding the High Court judgment to the department and reflects his continued demand for implementation of the Court's order.
The allegations have drawn attention as they concern an alleged failure by a government department to implement a subsisting judgment of the High Court in favour of a former judicial officer.
