Misuse of Section 95 of TLR LR Act, corrupt racket of Tehshildar and DCMs harass land owners for bribes , no action

The crucial section 95 of the Tripura Land Revenue and Land Reforms (TLRLR) Act-1960 empowers the Tehshildars and DCMs to make correction in the land records of people, specially in regard to title , ‘Khatiyan’and ‘Daag’ number through intervention of the DMs of districts but there is no time limit or provision for action against errant DCMs and Tehshildars who extort bribes and harass people by unnecessarily delaying the process . Taking advantage of this process the corrupt-to-the-bone racket of DCMs and Tehshildar scums continue to make life hell for the land owners of Tripura. With one excuse or the other the racket of Tehshildars and DCMs force people to move about between office and home for 3/4 or even five years . A helpless woman today shed tears in the Dukli block office as she has been moving to and from office for the past more than six years and as a result she can not procure money for her daughter’s marriage by selling off part of her land holding. What is worse , in many cases the corrupt Tehshildars in collaboration with DCMs deliberately make wrong entries or insert errors in land records to extort hefty amount of bribes from ordinary land owners.

Speaking on condition of anonymity a land owner said that as per rule all land owners having errors in their titles , ‘Khatiyan’or ‘Daag’ numbers have to file applications to the DM of his respective district and then the DM passes on the application in order to the SDM, DCM and finally the Tehshildar whom it is extremely difficult to find in office during working hours . “It generally takes at least 3/4 years for even a very small and nominal error to be corrected but in many cases the applications are kept pending for longer periods on one excuse or the other ; in case an applicant tries to persuade the Tehshildar to accelerate the process he is asked why he was not there when the great Tehshildar was on the field but in all cases these are found to be false claims” said an applicant , adding that these dirty tricks are resorted to for extorting bribes from the land owner applicants . He said that the tables of all DM offices in the state are overflowing with applications from land owners under Section 95 and it will take at least a decade , if not longer, for all the cases to be sorted out. “ This is only a tip of the iceberg ; the way the evil nexus of Tehshildars and DCMs have been wreaking havoc with state’s land records for slush money besides deliberately inserting errors and changing ownership records to facilitate even government land by touts and brokers , a major calamity in the form of mass revolt will strike the state sooner rather than later” the man said .

The man said that it is imperative that the revenue department and ministry look into this important matter seriously for a solution to avert larger trouble already brewing. According to him the government , represented by the DMs, should form committees with Tehshildars and DCMs to go into cases of applications under Section 95 and fix hours of hearing in all Mouzas under Tehshils controlled by DCMs . Unless this is done without any further delay by the DMs after looking into the actual scenario , there will be massive chaos and political consequences will be serious.
