Tripura HC sets aside DCDRC president’s removal over procedural lapses

The High Court of Tripura has set aside the removal of the President of the District Consumer Disputes Redressal Commission (DCDRC), West Tripura, holding that the action was taken without following principles of natural justice.

A division bench comprising Justice Dr T Amarnath Goud and Justice S Datta Purkayastha observed that the authorities failed to issue a show-cause notice or pass a reasoned order before removing the petitioner through a notification dated February 12, 2026.

The petitioner had challenged both the inquiry report dated January 22, 2026, and the removal notification, alleging violation of the Consumer Protection Rules, 2020, and denial of a fair opportunity to defend himself.

The court noted that copies of complaints, witness statements and other materials relied upon in the inquiry were not supplied to the petitioner despite repeated requests.

Setting aside the removal order, the bench directed the respondents to issue a fresh show-cause notice and pass a reasoned order after considering the petitioner’s explanation.

The court, however, clarified that the petitioner would not be allowed to function as President of the DCDRC, West Tripura, during the process.

The writ petition and pending miscellaneous applications were disposed of accordingly.
