Complaint Filed Against Agartala Smart City CEO Dr. Shailesh Kumar Yadav for Circulating False Notice on Lawful THRC-Ordered Survey at MBB College Lake

A serious complaint has been filed against Dr. Shailesh Kumar Yadav, IAS, Chief Executive Officer of Agartala Smart City Limited (ASCL), accusing him of publishing and circulating false, misleading, and defamatory information regarding a lawful survey jointly ordered by the Tripura Human Rights Commission (THRC) and the Revenue Department, Government of Tripura.
According to the complaint, the Revenue Department (LR Cell), through Memorandum No. F.4(10)-RCC/2025 dated October 13, 2025, issued in compliance with Order No. F.THRC/3392 dated September 22, 2025 of the Hon’ble Chairman, Tripura Human Rights Commission, constituted a survey team from the Agartala East Revenue Circle. The team included the Deputy Collector & Magistrate (DCM), Revenue Inspector, Surveyor, and Tehsildar to conduct a field survey and prepare a report on encroachment around MBB College Lake.
Copies of the memorandum were officially endorsed to the Secretary, THRC, District Magistrate & Collector (West Tripura), Director of Higher Education, and the Principal of MBB College. The complainants were directed to remain present during the survey, which was duly scheduled for October 18, 2025, at 11:00 AM.
The complainants, Shri Nikhil Debnath and Shri Jayanta Bhattacharjee, along with their advocate and representatives from several media organizations, attended the survey to ensure full transparency and compliance with government directives.
However, on the same day, Agartala Smart City Limited, under the authority of Dr. Shailesh Kumar Yadav, posted a public statement on its verified Facebook page accusing that some unknown persons claiming to be from the Tripura Human Rights Commission of forcefully entering MBB Lake without tickets, failing to show any authorization, and spreading misinformation. The post also mentioned that an FIR would be lodged against them.
The complainants have termed this statement false, baseless, and defamatory, arguing that it was a deliberate attempt to mislead the public, discredit the Tripura Human Rights Commission, and intimidate lawful government officers executing a THRC-directed order. They allege that Dr. Yadav’s post constitutes gross misconduct, abuse of official position, and obstruction of a lawful process.
The complaint cites several Supreme Court precedents, including:
State of Punjab v. Ram Singh (1992) 4 SCC 54, where the Court defined misconduct as willful violation of lawful directions or conduct unbecoming of a government servant.
Union of India v. J. Ahmed (1979) 2 SCC 286, emphasizing that government officials must act responsibly and avoid bringing disrepute to public administration.
R. Sai Bharathi v. J. Jayalalitha (2004) 2 SCC 9, reaffirming that misuse of position to spread falsehood constitutes misconduct under public law.
The complainants have urged Chief Secretary to Investigate the conduct of Dr. Shailesh Kumar Yadav for circulating false and defamatory information through an official platform and to order the immediate withdrawal of the misleading Facebook post from all public domains.
The complainants also demanded to take appropriate disciplinary action against Sailesh Yadav for misrepresentation and obstructing a lawful inquiry.
It is further alleged that Dr. Yadav forcefully inaugurated the MBB College Park in the presence of Chief Minister Dr. Manik Saha, MP Rajib Bhattacharjee, and Mayor Dipak Majumder, allegedly keeping them in the dark about the Tripura Human Rights Commission’s direction not to officially launch the disputed park.
The complainants have termed this act as a serious breach of administrative ethics and an attempt to undermine the authority of a statutory body, urging immediate intervention by the state government and the concerned oversight agencies.
