HC Issues Notice to Tripura University Over Challenge to Executive Council’s Constitution and Suspension Order

Hon’ble Justice Shri S. D. Purkhaystha of the Tripura High Court has issued notices to Tripura University and two private respondents in WPC 551/2025, filed by petitioner Sri Krishna Das, Executive Engineer of the University.

The petitioner has challenged the constitution of the University’s Executive Council (EC), which had suspended him in its 46th meeting held on 14th August 2025, allegedly without assigning any reason.

Das argued that the formation of the EC violated Statutes 12A (iv) of the First Amendment, 2010 of the TU Act, 2006, which stipulates that only the senior-most professor other than the Dean, by rotation, can be nominated by the Vice Chancellor as an EC member. However, he alleged that Prof. Badal Kumar Datta attended the meeting in place of Prof. Shyamal Das, the University’s senior-most professor.

The petitioner also questioned the authority of Sri Praveer Sexana, Under Secretary of the Ministry of Education, who allegedly attended the EC meeting without any legal mandate.

Further, Das has contested the addendum and corrigendum issued on 18th August 2025 relating to his suspension order, contending that such actions could only be approved by the EC and not by the Registrar acting independently.

After the initial hearing, the High Court expressed prima facie satisfaction with the petitioner’s submissions and accordingly issued notices to the University and other respondents.

The petitioner was represented by Senior Advocate Sri Purushottam Roy Barman, along with advocates Sri Deepjoyti Pal, Sri Kawsik Nath, and Sri Samarjit Bhattachejee.

The matter has been listed for its next hearing in November 2025.
