High Court stays transfer of teacher of grant-in-aid school from Fatikroy to Dharma Nagar

In a significant and consequential order the high court of Tripura has stayed the transfer of a teacher from Fatikroy HS (+2) grant in aid school of Unakoti district to Golden Valley HS (+2) grant in aid school in Dharma Nagar of north Tripura. There was no provision of transfer of privately run grant-in-aid schools as per the new rules for such schools introduced in the year 2005. But the rule was amended by the incumbent BJP government in the year 2020 making a provision for merger of grant-in-aid schools on ground of lack of students and transfer of teachers.
Sources from Fatikroy said that the Fatikroy HS (+2) grant in aid school is running well with adequate number of students and teachers but for an inexplicable reason Sajal Deb , a teacher of the school , had been transferred by the director of education to Dharma Nagar Golden Valley HS (+2) school in violation of the amended rules for grant in aid schools on July 16.
The teacher Sajal Deb had got a writ petition filed in the high court against his illegal transfer by his lawyer, senior advocate Purushottam Roybarman. After hearing the case yesterday Justice Sabyasachi Datta Purkayastha stayed the transfer of teacher Sajal Deb and directed the education deparment to present their justification of the transfer within next fourteen days. The petitioner teacher Sajal Deb was represented in the high court bench by senior advocate Purushottam Roybarman and his juniors advocate Samarjit Bhattacharjee and Kaushik Nath. Speaking to media persons advocate Purushottam Roybarman said that many cases of illegal , vindictive and motivated transfers of teachers of grant in aid schools have been pending in the high court.
