Tripura Government Notifies New Rules for Land Diversion under Land Revenue and Land Reforms Act, 2025

In a major regulatory development, the Government of Tripura has notified the "Tripura Land Revenue and Land Reforms (Diversion of Land) Rules, 2025" under the powers conferred by Sections 20 and 98 of the Tripura Land Revenue and Land Reforms Act, 1960. The new rules, aimed at streamlining and regulating the diversion of land for non-agricultural and other purposes, came into force on June 2, 2025 with the publication in the Tripura Gazette.

The rules define key terms such as agricultural land, diversion of land, and water bodies, and clearly outline procedures for seeking permission for diversion of land or water bodies to other uses. The process mandates submission of ownership records, identity proof, and minimum Rs. 2000 application fees, with provisions for both online and offline submissions.

Importantly, the new framework introduces a system of deemed approval for land diversion applications related to industrial zones, MSMEs (up to 1 acre), and registered startups, provided no decision is communicated within 14 working days of application.

The Competent Authority for approving land diversions has been designated as the District Magistrate & Collector for urban areas and the Sub-Divisional Magistrate for rural areas. In cases involving water bodies, approval must also be obtained from the State Level Advisory Committee (SLAC) after mandatory environmental and departmental clearances.

The rules also empower the government to take enforcement action against unauthorized land diversions, including recovery of costs as arrears of land revenue. Additionally, a provision has been introduced for periodic review of approved land diversions to assess environmental and community impact.

These new rules mark a significant step in ensuring planned land use, protecting agricultural resources and water bodies, while also encouraging industrial and entrepreneurial development in Tripura.
