High Court's landmark judgment : SSA teachers to be regularised within six months with arrear payment of salary

In a landmark judgment the high court of Tripura yet again appeared in the role of saviours for depressed people-this time for over six thousand Samagra  Shiksha Abhiyan (SSA) teachers. Passing final orders on a long-pending case of the teachers the division bench of the high court comprising chief justice A.A. Kureshi and justice S.G.Chatterjee ordered the state government to regularize their services with effect from the end of five year period of their service as well as to give them not only full and regular salary but also to pay arrears from the date of their service regularization at the end of the five year period. Besides, the order made it clear that the SSA teachers who have been in service for close to fourteen years will be entitled to all retiral benefits like provident fund, gratuity, leave encashment and government-paid pension. Advocates Purushottam Roy Barman and advocate Shamik Deb represented the Samagra Shiksha Abhhiyan teachers in the case and expressed satisfaction over the judgment passed today. However, sources in the high court said that the state government is likely to appeal today's order in supreme court citing resource constraint and lack of a clear-cut policy at the central level.

The SSA teachers had been recruited in a phased manner from the year 2006 after the lapse of the scheme of total literacy programme by the then left front government. However, despite having opportunities the left front did not regularize their services even though the government of Arunachal Pradesh had regularized the services of SSA teachers long back. Out of frustration over the uncertainty of their service status the SSA teachers had filed a writ petition last year and this was disposed today by the high court's division bench today though there is strong possibility that the state government will go in appeal to supreme court at least to buy time and delay the matter, if not anything else.
