SC advises LF to file writ in High Court, Congress files writ in SC

Agartala, May 15, 2019: The writ petition filed by Left Front candidate for West Tripura parliamentary constituency Sankar Prasad Datta was presented for hearing at the holiday bench of Supreme Court, but the bench headed by justice of Indira Banerjee and Justice Sanjib Khanna suggested the petitioner to file the case at High Court first.

P V Dinesh, the advocate of Sankar Prasad Datta said that after the suggestion of the apex court on Tuesday, the writ petition has been withdrawn and it will again file in the High Court of Tripura on Wednesday.

Presenting his argument in favour of writ, advocate Dinesh said that as per the internal documents of Election Commission, the massive rigging and malpractices during April 11 elections for the constituency have been established.

On May 9 last, the Supreme Court declined to allow an urgent hearing on their writ petition challenging Election Commission’s decision of re-polls in the constituency and the Chief Justice of India (CJI) Rajan Gogoi rejecting the plea said  as the court finds no urgency in the petition and remarked- "It will be listed as usual".

It may be mentioned here that  LF candidate Datta filed the writ in the apex court seeking fresh elections in the entire constituency demanding countermanding of April 11 elections.

While, another writ petition by opposition Congress was filed on Tuesday seeking the apex court's intervention for re-poll in 433 polling booths of West Tripura Lok Sabha seat. PCC's vice president Pijush Kanti Biswas said that on behalf of AICC senior leader Joyram Ramesh filed the writ petition seeking the SC's intervention for ordering re-poll in 433 polling stations at the holiday bench of SC.
