Fate of 10,323 foredoomed for ever? No attempt likely to revive the 12 thousand non-teaching posts , cleared by supreme court

Agartala October 06, 2019 : Education minister Ratan Lal Nath's ostensible 'sympathy' and 'expression of interest' notwithstanding , the fate of 10,323 teachers seem foredoomed for ever following the bizarre judgment of the high court of Tripura on October 3. At a time when judges of the apex court 'recuse' themselves one after another from hearing the petition of a detained rights activist, it seems unlikely that the supreme court will provide any succour to the doomed 10,323 ad hoc teachers, victims of a longterm  'grand design'. Hoping against hope, the doomed ad hoc teachers are preparing to file a special leave petition in the supreme court at the end of the current  vacation but that holds out no promise of justice or remedy . In a different context  BJP's 'Bhishma Pitamaha' L.K.Advani had once perceptively termed the media’s role  during emergency in his inimitable style : 'You were asked to bend but you crawled' . This is eminently applicable to other vital pillars of Indian democracy now.

Now coming back to the mundane reality, highly placed official sources in the department of secondary education hinted that no affirmative action would  be possible to safeguard the jobs of the ill-fated 10,323 ad hoc teachers or accommodate them in any other positions. It was on June 27 2017 that the then left front government had put out notification inviting application for non-teaching posts of 'Academic Counsellor', 'Student Counsellor', ‘School Library Assistant', 'Hostel Warden' and  'Programme Assisant' to accommodate the ad hoc teachers , having created the posts in a cabinet meeting on the basis of power conferred by Article 309 of the constitution. But the move had been aborted by a Madhyamik passed 'Tabla' player Debasish Paul Chowdhury of Charilam by filing a petition in the apex court with appropriate backing from high-ups in then upcoming power hierarchy. But finally the posts along with the contempt charge brought on then chief secretary Sanjib Ranjan had been cleared by the supreme court, paving the way for recruitment to such posts. But the current ruse of the authority for non-recruitment to such posts is that they were naturally abolished within one year of creation as per norms . However, sources who spoke on the issues did no answer the all-important query : why the non-teaching posts are not being revived by a decision of the state cabinet which is fully empowered to do so ?

In retrospect, what appears to be a dangerous precedent is that this is the first time in  the post-independence history of India  that perceived fallacies in government’s recruitment policy has been used to retrospectively  dispense with the services of as many as 10,323 teachers who had no charge or complaint against them. The judgement itself delivered on May 7 2014 is highly contradictory and discriminatory as evident from  a study of Para 121 and 127. While the rest of teaching and non-teaching employees recruited under the same impugned policy of August 30 2003 had been spared the axe , only 10,323 teachers were picked on for victimization . Besides, many other factors that militate against the hallowed concepts of natural justice and other crucial parameters of justice dispensation include violation of fundamental rights  enshrined in Articles 14 and 16 (1) of the constitution as also of the Articles  37,38 , fundamental right enshrined in Article 21 as well as the Preamble of the Indian constitution which proclaim 'justice social , economic and political' as founding principles of governance through the constitution as part of basic structure. But who listens and who cares ? The ghosts who gleefully celebrated the corpses of 10,323 on the star-cursed date of March 29 2017 continue to gloat over rigged success finally, albeit furtively.
